  1. Postanowienia ogólne i dane kontaktowe:

    1.3. Zasady składania zamówień, zakupów i składania reklamacji zawiera niniejszy Regulamin.
    1.4. Warunkiem skorzystania ze Sklepu oraz zawarcia Umowy Sprzedaży jest akceptacja postanowień niniejszego regulaminu. Klient poprzez jego akceptację wyraża zgodę na wszystkie postanowienia i zobowiązuje się ich przestrzegać. W przypadku semicustomów/customów wpłata zadatku jest równoznaczna z akceptacją regulaminu.
  2. Definicje:
    2.1. Sprzedawca / Tkaczka – Sandra Dubik prowadząca działalność
    gospodarczą pod firmą Dubikowa Textile, pod adresem ul. Jana Kasprowicza 1f 62-640 Puszczykowo
    2.2. Klient – osoba fizyczna, osoba prawna lub jednostka organizacyjna nie będąca osobą prawną, której przepisy szczególne przyznają zdolność prawną, składająca Zamówienie w ramach Sklepu i dokonująca zakupów za pośrednictwem Sklepu.
    2.3. Zamówienie – czynność, oświadczenie woli Klienta zmierzające bezpośrednio do zawarcia Umowy Sprzedaży i spełnienia świadczenia na rzecz Klienta, na warunkach wskazanych w niniejszym Regulaminie.
    2.4. Regulamin – niniejszy Regulamin Sklepu.
    2.5. Sklep – miejsca, w których Klient może dokonywać Zamówień i zakupów
    określonych Towarów (pkt 1, ppkt 1.2.1. i 1.2.2.)
    2.6. Towar – gotowy produkt znajdujący się w sklepie bądź wykonany na zamówienie klienta.
    2.7. Semicustom – tkanina tkana na indywidualne zamówienie z różną ilością dostępnych opcji personalizacji zależną od konkretnego projektu, jedna mniejszą niż w customie.
    2.8. Custom – tkanina przygotowana w pełni według zamówienia klienta.
    2.9. Legacy – tkanina, której data zdjęcia z krosna jest określona przez klienta – zwykle związana z dniem narodzin dziecka)
    2.10. Feedback – miejsce w social mediach, gdzie kupujący zamieszcza opinie o kupnie/sprzedaży z klientem.
    2.11. Personalizacja – dokonanie zmian w gotowym produkcie według wskazówek klienta.
    2.12. Tkanina „niespodzianka” – tkaniny, które klient zamawia jako
    semicustom/custom i nie chce widzieć poszczególnych etapów powstawania.
  3. Towary dostępne w sklepie:
    3.1. ręcznie farbowane i tkane chusty do noszenia dzieci
    3.2. ręcznie farbowane i tkane szale, szaliki, kominy,
    3.3. ręcznie farbowane i tkane tkaniny użytkowe
    3.4. ręcznie tkane chusty do noszenia dzieci
    3.5. ręcznie tkane szale, szaliki, kominy, chusty
    3.6. ręcznie tkane tkaniny użytkowe
    3.7. torebki/portfele szyte z użyciem tkanin wytwarzanych przez Sprzedawcę
    3.8 odzież
    3.9 ręcznie szyte nosidła dla dzieci
  4. W ofercie Sklepu znajdują się również towary wykonywane na indywidualne zamówienie Klienta.
  5. Klient chcący dokonać indywidualnego Zamówienia, powinien skontaktować się ze Sprzedawcą przez fanpage, formularz dostępny na stronie sprzedawcy lub pod adresem e-mail wskazanym w niniejszym Regulaminie.
  6. Po uzgodnieniu parametrów i cech Towaru z Klientem zostanie on przygotowany na jego indywidualne zamówienie.
  7. Sprzedawca zwraca uwagę na kwestie wyłączenia prawa do odstąpienia od Zamówienia w przypadku Towarów na indywidualne zamówienie, które to są opisane w niniejszym regulaminie.
  8. Płatność:
    8.1. Płatności można dokonać przed powstaniem tkaniny lub gdy tkanina jest już gotowa.
    8.2. Możliwe formy płatności : przelew bankowy, Revolut, PayPal ( w przypadku
    płatności PayPal należy doliczyć 5 % wartości produktu).
    8.3. Wpłaty przyjmowane są w walucie €
    8.4. Istnieje możliwość płatności ratalnych ( należy je ustalić z Tkaczką przed wpłatą zadatku).
  9. Wysyłka:
    9.1. W przypadku wcześniej ustalonych ratach – towar może być wysłany po spłacie 80%
    wartości (przy nienagannym feedbacku kupującego). W razie negatywnych opinii w feedbacku – wysyłka następuje po wpłacie całej należnej kwoty.
    9.2. Możliwe formy wysyłki : kurier, poczta. Deklarowana jest pełna wartość towaru – tkaczka nie odpowiada za cło i opłaty jakie mogą zostać nałożone przez służby celne
    kraju docelowego.
    9.3. Wysokość kosztu wysyłki sprawdzona zostanie w momencie otrzymania adresu dostawy ( klient ma prawo wybrać przewoźnika na podstawie dostępnych firm kurierskich).
    9.4. W przypadku zagubienia paczki przez przewoźnika Tkaczka nie ponosi
    odpowiedzialności.
  10. Zwroty / Reklamacje:
    10.1. Klient ma 14 dni na zwrot towaru kupionego jako gotowy
    10.2. Zwrotom nie podlega towar zrobiony na zamówienie oraz taki, w którym
    dokonano personalizacji.

10.3. Zwrotom nie podlegają tkaniany “niespodzianki”.
10.4. W przypadku znalezienia błędu tkackiego (supełka na chuście) – podlega ona reklamacji – tkaczka zobowiązuje się do naprawienia tego w terminie 7 dni roboczych od otrzymania chusty (Tkaczka pokrywa koszty wysyłki).
10.5. Zwrotom nie podlegają pełnowartościowe produkty – w których wystają
końcówki przędzy, znajdzie się mały przeskok wzoru, przesunięcia kolorów.
Elementy te nie wpływają na właściwości tkaniny, a są normalne w przypadku
rękodzieła.

TOWARY NA ZAMÓWIENIE

  1. Informacje ogólne:
    11.1. Aby dokonać rezerwacji terminu należy w ciągu 7 dni roboczych opłacić
    zadatek ustalony indywidualnie z Tkaczką.
    11.2. Zadatek nie podlega zwrotowi jeśli klient zrezygnuje z tkania.
    11.3. Na podstawie ustalonego z klientem składu tkaniny oraz wytycznych odnośnie długości i wykończenia tkaniny zrobiona zostanie wstępna wycena.
    11.4. W przypadku gdy klient pozostawia wybór składu tkaniny tkaczce lub gdy
    tkaczka proponuje kilka możliwości składu należy pamiętać, że odczucia odnośnie grubości, miękkości czy innych aspektów są indywidualne.
    11.5. Finalna długość tkaniny może wahać się o 2% więcej lub mniej w zależności od wybranej przędzy, sposobu farbowania, wybranego splotu.
    11.6. Data umówienia tkania jest umowna i zależy od możliwości tkaczki (wyjątek
    dotyczy tkania Legacy).
    11.7. W przypadku przędz importowanych mogą pojawić się opóźnienia niezależne od Tkaczki. Tkaczka zobowiązuje się poinformować o takiej ewentualności klienta.
    11.8. Termin realizacji może ulec wydłużeniu przy dużej ilości próbek kolorów
    wątków, pruciu na życzenie klienta itp. W takim przypadku Tkacz ma prawo doliczyć dodatkowe koszty o czym poinformuje Klienta.
    11.9. Klient zobowiązuje się do nieprzerwanego kontaktu z tkaczka (tzn gdy Tkacz zaczyna pracę nad tkaniną klient zobowiązuje się odpisać na wiadomości w przeciągu doby)
    11.10. Podczas farbowania osnowy/ wątku (na mokro) kolory są inne niż po ich
    utrwaleniu i wyschnięciu przędzy.
    11.11. Kolory mogą się różnić na zdjęciach z kolorami na żywo – jest to zależne m.in. od sprzętu na którym wyświetlane są zdjęcia, od pory dnia gdy zdjęcia były robione.
    11.12. Finalny efekt tkaniny ma prawo się różnić od wyobrażeń – w przypadku
    rękodzieła każda tkanina jest niepowtarzalna. (Tkacz zobowiązuje się do uzyskania odcieni zbliżonych na otrzymanej inspiracji).

11.13. Na gotowej tkaninie mają prawo wystąpić: wystające nitki wątków, przeskok
nitki, przesunięcia kolorów czy kolor powstały na łączeniu kilku innych kolorów.
11.14. Podczas prania tkanina ma prawo barwić wodę (krwawić), wynika to z
nadmiaru barwnika i jest normalne.

1.3 The rules for placing orders, purchases and filing complaints are contained in these Regulations.
1.4 The condition for using the Store and concluding a Sales Agreement is acceptance of the provisions of these Regulations. By accepting it, the Customer agrees to all the provisions and undertakes to abide by them. In the case of semicustoms/customs, payment of the deposit is tantamount to acceptance of the Regulations.

Definitions:
2.1. seller / weaver – Sandra Dubik conducting business under the name of.
under the business name Dubikowa Textile, at the address Jana Kasprowicza 1f 62-640 Puszczykowo.
2.2 Customer – a natural person, a legal person or an organizational unit that is not a legal person but to which special regulations grant legal capacity, placing an Order in the Store and making purchases through the Store.
2.3 Order – an action, a declaration of will of the Customer aiming directly at the conclusion of a Sales Agreement and fulfillment of performance for the Customer, under the terms and conditions indicated in these Regulations.
2.4. Regulations – these Regulations of the Store.

2.5. Store – places where the Customer can make Orders and purchase
specific Goods (item 1, sections 1.2.1. and 1.2.2.).
2.6. Merchandise – finished product located in the store or made to the customer’s order.
2.7. Semicustom – custom woven fabric with different number of available personalization options depending on the specific project, one less than in custom.
2.8. Custom – fabric prepared fully according to the customer’s order.
2.9. Legacy – fabric whose date of removal from the loom is determined by the customer – usually related to the day of birth of the child).
2.10. Feedback – a place on social media where a buyer posts feedback on a purchase/sale with a customer.
2.11. Personalization – making changes to the finished product according to the customer’s instructions.
2.12. “Surprise” fabric – fabrics that the customer orders as a
semicustom/custom and does not want to see the individual stages of creation.

Goods available in the store:
3.1. hand-dyed and woven baby slings
3.2. hand-dyed and woven shawls, scarves, chimneys,
3.3. hand-dyed and woven utility fabrics
3.4. hand-woven scarves for carrying children
3.5. hand-woven shawls, scarves, chimneys, wraps
3.6. hand-woven utility fabrics
3.7. handbags/wallets sewn using fabrics produced by the Seller
3.8 clothing
3.9 hand-sewn baby carriers

The Store also offers goods made to an individual Customer’s order.

A Customer wishing to make an individual Order should contact the Seller through the fanpage, the form available on the Seller’s website or at the e-mail address indicated in these Regulations.

Once the parameters and characteristics of the Goods are agreed with the Customer, they will be prepared for the Customer’s individual order.

The Seller draws attention to the issues of exclusion of the right to withdraw from the Order in the case of Goods on individual order, which are described in these Regulations.

Payment:
8.1 Payment can be made before the fabric is created or when the fabric is ready.
8.2 Possible forms of payment : bank transfer, Revolut, PayPal ( in case of
PayPal payment you need to add 5% of the product value).
8.3. payments are accepted in € currency.
8.4. there is a possibility of installment payments ( it should be agreed with Weaver before paying the deposit).

Shipping:
9.1. In case of pre-arranged installments – goods can be shipped after payment of 80% of the
value (with impeccable feedback of the buyer). In the case of negative feedback in the feedback – shipping is carried out after payment of the entire amount due.
9.2 Possible forms of shipment : courier, post. Declared is the full value of the goods – the weaver is not responsible for customs duties and fees that may be imposed by customs services
of the destination country.

9.3 The amount of shipping cost will be checked upon receipt of the delivery address ( the customer has the right to choose the carrier on the basis of available courier companies).
9.4 In case of loss of the parcel by the carrier, Weaver does not bear
responsibility.

Returns / Complaints:
10.1 The customer has 14 days to return goods purchased as finished
10.2 Returns are not subject to goods made to order and those in which
personalized.

10.3 Returns are not subject to “surprise” fabrics.
10.4 In case of finding a weaving error (knot on the scarf) – it is subject to a complaint – the weaver undertakes to fix it within 7 working days from the date of receiving the scarf (the weaver covers the shipping costs).
10.5 Full-quality products – in which protruding
yarn ends, there will be a small pattern shift, color shifts.
These elements do not affect the properties of the fabric, and are normal for
handicrafts.

CUSTOMIZED GOODS

General information:
11.1 In order to book an appointment, it is necessary to pay within 7 working days a deposit agreed individually with the Weaver.
11.2 The deposit is not refundable if the customer cancels the weaving.
11.3 Based on the composition of the fabric agreed with the customer and guidelines for the length and finish of the fabric, a preliminary quote will be made.

11.4 When the customer leaves the choice of fabric composition to the weaver or when the weaver proposes several composition options, please note that the feelings about thickness, softness or other aspects are individual.
11.5 The final length of the fabric may vary by 2% more or less depending on the yarn selected, the dyeing method, the weave selected.
11.6 The date of appointment for weaving is contractual and depends on the ability of the weaver (exception applies to Legacy weaving).
11.7 In the case of imported yarns, delays beyond the control of the Weaver may occur. The Weaver undertakes to inform the customer about such eventuality.
11.8. The lead time may be extended with a large number of color samples
of wefts, pilling at the customer’s request, etc. In this case, the Weaver has the right to add additional costs about which he will inform the customer.
11.9 The customer undertakes to keep in touch with the weaver at all times (i.e. when the Weaver starts working on the fabric the customer undertakes to write back to the messages within 24 hours).
11.10. During dyeing of warp/weft (wet) the colors are different than after their
fixation and drying of the yarn.
11.11. Colors may differ in photos with live colors – this depends, among other things, on the equipment on which the photos are displayed, the time of day when the photos were taken.
11.12. The final effect of the fabric has the right to differ from the imagination – in the case of craftsmanship each fabric is unique. (The weaver undertakes to obtain shades similar on the received inspiration).

11.13. On the finished fabric there is a right to occur: protruding threads of wefts, thread jumping threads, color shifts or color formed on combining several other colors.
11.14. During washing, the fabric has the right to dye water (bleeding), this is due to the excess dye and is normal.
